If settlement fails, evidence is led, witnesses are examined and final arguments are advanced until the decree is passed.
A mutual consent divorce is normally completed in about six to eighteen months. The court records a first motion, allows a cooling-off period of six months, and then passes the decree on the second motion. In suitable cases the cooling-off period can be waived by application.
Marriage proof (certificate, invitation or photographs), address and identity proof of both spouses, income proof where maintenance is claimed, details of children, and any relevant communication, medical or police records supporting the grounds.
